These Terms and Conditions govern all relationships between Diaeta (hereinafter "the Provider") and any individual (hereinafter "the Patient" or "the Client") using our dietitian consultation services. By booking an appointment or using our services, you acknowledge that you have read, understood and accepted these terms.

1. Preamble
These Terms and Conditions (hereinafter "T&C") apply to all dietetic services provided by Diaeta, in accordance with applicable Belgian legislation, including:
- The Belgian Act of 22 August 2002 on Patient Rights
- The General Data Protection Regulation (GDPR - EU Regulation 2016/679)
- The Belgian Code of Economic Law (Book VI - Market Practices and Consumer Protection)
- The Belgian Act of 30 July 2018 on the protection of individuals with regard to the processing of personal data
- The Royal Decree of 19 February 1997 on the professional title of dietitian
By using our services, the Patient acknowledges having read these T&C and accepts them without reservation.

The Provider practices in several medical centres in the Brussels region. Specific addresses are provided when booking an appointment.
The title of "dietitian" is a protected professional title under Belgian law. Only professionals holding a visa issued by the FPS Public Health and accreditation granted by the Federation Wallonia-Brussels or the Flemish Community may practice under this title.
3. Description of Services
Diaeta offers personalised dietetic consultation services, including:
- Initial consultation: comprehensive nutritional assessment, body composition analysis, establishment of personalised goals and development of a tailored eating plan
- Follow-up consultations: regular support, dietary plan adjustments, motivational support and progress tracking
- Specialised care: irritable bowel syndrome (IBS/FODMAP), type 2 diabetes, cholesterol management, GLP-1 treatment support, sustainable weight loss
- Nutrigenetics advice: interpretation of genetic tests for personalised nutrition
Our services complement medical care and do not in any way replace medical treatment. The dietitian collaborates with attending physicians and other healthcare professionals in the patient's interest.
4. Booking Appointments
4.1 Booking methods
Appointments can be booked:
• Online via our booking system at diaeta.be/booking
• Via DoctorAnytime platform at doctoranytime.be
• By email at info@diaeta.be
Appointment confirmation is sent by email and/or SMS. An appointment is considered final upon receipt of confirmation.
4.2 Information required
When booking an appointment, the Patient is asked to provide:
• Full contact details (surname, first name, telephone, email)
• Reason for consultation
• Any relevant medical information (allergies, current treatments, conditions)
5. Cancellation and Rescheduling
5.1 By the Patient
Any cancellation or rescheduling must be made at least 24 hours before the scheduled appointment time.
In case of late cancellation (less than 24 hours) or unjustified absence, a cancellation fee of 50% of the consultation fee may be charged.
In case of duly justified force majeure (sudden illness, accident, death of a relative), no cancellation fee will be applied.
5.2 By the Provider
If the dietitian is unable to attend (illness, personal emergency), the Patient will be notified as soon as possible and a new appointment will be offered at a convenient date.
In case of cancellation by the Provider, no fee will be due by the Patient.
6. Fees and Payment
6.1 Fees
Current fees are displayed on the diaeta.be website and communicated to the Patient before booking.
Fees are stated in euros (€), all taxes included.
Diaeta reserves the right to modify its fees. Any modification will be published on the website and will not affect already confirmed appointments.
6.2 Payment methods
Payment is due at the end of each consultation, unless otherwise agreed in advance.
Accepted payment methods:
• Electronic payment (Bancontact, credit/debit card)
• Bank transfer (upon request)
• Mobile payment applications (Wero)
An invoice or care certificate is provided to the Patient upon request.
7. Mutual Fund Reimbursement
In Belgium, consultations with an NIHDI/NIHDI-accredited dietitian may be partially reimbursed by mutual funds/ziekenfondsen.
7.1 Reimbursement conditions
Reimbursement depends on your mutual fund and coverage. Generally:
• A medical prescription may be required
• The number of reimbursed sessions per year may be limited
7.2 Procedure
The patient must download a document for the dietitian from their mutual fund's website before their consultation. During the appointment, the dietitian completes and signs this document then returns it to the patient. The patient then submits this document to their mutual fund to obtain reimbursement.
Diaeta is not responsible for the amount or refusal of reimbursement by your mutual fund. We advise you to check your entitlements with your insurer before the first consultation.
8. Right of Withdrawal
In accordance with the Belgian Code of Economic Law (Book VI), the Patient-consumer has a 14 calendar day right of withdrawal from the conclusion of a distance contract (online booking).
8.1 Exercising the right of withdrawal
To exercise this right, the Patient must notify their decision in writing (email or letter) before the 14-day period expires.
If the Patient has expressly requested that the consultation begin before the withdrawal period expires and the service has been fully performed, the right of withdrawal is lost.
8.2 Exceptions
The right of withdrawal does not apply to fully performed services if the Patient has given prior consent and acknowledged losing their right of withdrawal once the service is fully executed.
9. Patient Obligations
The Patient undertakes to:
- Provide accurate and complete information about their health condition, medical history, current treatments and lifestyle
- Report any changes in their health condition or treatments
- Inform the dietitian of any known food allergies or intolerances
- Follow the dietitian's recommendations to the best of their ability
- Arrive on time for appointments or notify in case of impediment
- Comply with the cancellation conditions set out in Article 5
- Settle fees according to the terms set out in Article 6
The quality of dietetic support depends on the honesty and accuracy of the information provided by the Patient.
10. Dietitian Obligations
The dietitian undertakes to:
- Practice their profession in accordance with professional standards and current scientific knowledge
- Provide personalised advice adapted to the Patient's individual situation
- Respect professional secrecy and the confidentiality of Patient data
- Collaborate with other healthcare professionals in the Patient's interest
- Stay informed of scientific developments and pursue continuing education
- Inform the Patient in a clear and understandable manner
- Provide a care certificate after each consultation
- Respect the Patient's rights as defined by the Act of 22 August 2002
11. Professional Secrecy and Confidentiality
The dietitian is bound by professional secrecy in accordance with Article 458 of the Belgian Criminal Code.
All information communicated by the Patient during the consultation is strictly confidential.
11.1 Communication with other professionals
With the Patient's consent, the dietitian may communicate with the attending physician or other healthcare professionals involved in care.
This communication aims to ensure coherent and optimal patient care.
11.2 Exceptions to professional secrecy
Professional secrecy may only be lifted in cases provided by law (state of necessity, testimony in court with authorisation, etc.).
12. Personal Data Protection (GDPR)
In accordance with the General Data Protection Regulation (GDPR - EU 2016/679) and the Belgian Act of 30 July 2018, Diaeta is committed to protecting your personal data.
12.1 Data controller
Diaeta, represented by Pierre Abou Zeid, is the controller of your personal data.

We collect data necessary for providing our services:
• Identification data (surname, first name, date of birth, contact details)
• Health data (medical history, treatments, anthropometric measurements, dietary habits)
• Billing data
This data is used exclusively for:
• Managing your appointments

• Monitoring your progress
• Issuing invoices and certificates
• Complying with our legal obligations
12.3 Legal basis for processing
The processing of your data is based on:
• Performance of the service contract
• Your explicit consent for health data
• Our legal obligations (retention of patient records)
12.4 Retention period
Your data is retained for the duration of your care and for 30 years after the last consultation, in accordance with applicable patient record regulations.
12.5 Your rights

• Right of access to your data
• Right to rectification of inaccurate data
• Right to erasure ("right to be forgotten"), subject to legal retention obligations
• Right to restriction of processing
• Right to data portability
• Right to object to processing
• Right to withdraw your consent at any time

12.6 Data security
We implement appropriate technical and organisational measures to protect your data against unauthorised access, loss or destruction.
13. Patient Rights
In accordance with the Belgian Act of 22 August 2002 on Patient Rights (amended in 2024), you benefit from the following rights:
- Right to quality care: you are entitled to quality care provided according to your needs and with respect for your dignity
- Right to free choice of practitioner: you freely choose your dietitian
- Right to information: you are entitled to clear information about your nutritional status and proposed recommendations
- Right to informed consent: no intervention is performed without your free and informed consent
- Right to respect for privacy: your data and privacy are protected
- Right of access to your file: you may consult and obtain a copy of your patient file
- Right to lodge a complaint: in case of breach, you may contact the federal mediation service "Patient Rights"

14. Limitation of Liability
14.1 Nature of advice
Dietetic advice is personalised and based on current scientific evidence. However:
• Results may vary from person to person
• Achievement of goals depends on the Patient's adherence to recommendations
• Dietetic advice does not constitute medical advice and does not replace a medical consultation
14.2 Exclusion of liability
Diaeta cannot be held liable for:
• Consequences resulting from inaccurate or incomplete information provided by the Patient
• The Patient's failure to follow recommendations
• Side effects related to dietary changes not reported to the attending physician
• Decisions made by the Patient without prior consultation with their doctor in case of pathology
14.3 Obligation of means
The dietitian is bound by an obligation of means, not results. They commit to applying all their skills and knowledge to best support the Patient.
15. Intellectual Property
All content on the diaeta.be website (texts, images, logos, meal plans, documents, videos) is protected by copyright and remains the exclusive property of Diaeta.
Documents provided to the Patient as part of their care (meal plans, advice sheets, etc.) are for personal use only and may not be reproduced, distributed or used for commercial purposes without prior written permission.
The Patient undertakes not to share, publish or commercialise the personalised documents provided to them.
16. Force Majeure
Neither party shall be held liable for failure to perform their obligations in case of force majeure.
Force majeure events include: natural disasters, epidemics/pandemics, government decisions, general strikes, prolonged power outages, or any other unforeseeable, irresistible event beyond the parties' control.
In case of force majeure, appointments will be rescheduled at no charge as soon as circumstances permit.

We commit to handling your complaint within 30 days.

18. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Belgian law.
In case of dispute and failing amicable resolution, the courts of Brussels (Belgium) shall have sole jurisdiction.
For consumers residing in the European Union, this clause does not affect the rights conferred by the legislation of their country of residence.
19. Modifications to Terms and Conditions
Diaeta reserves the right to modify these Terms and Conditions at any time.
Modifications will be published on diaeta.be with an update date.
The applicable Terms and Conditions are those in force at the time of booking.
For ongoing care, new terms apply after notifying the Patient.
20. Severability
If any provision of these Terms and Conditions is found to be null or unenforceable under any law or court decision, the other provisions shall remain in full force and effect.
The null provision shall be replaced by a valid provision that most closely reflects the original intent.
